Terms of Service

These Terms govern your use of Mamagayo, an AI-powered spoken-language tutoring service (“Service”) operated by [FOUNDER: legal entity name], [FOUNDER: SIRET], [FOUNDER: registered address] (“we”, “us”).

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.

1. The Service

Mamagayo provides spoken and written language-practice sessions with an AI conversational partner, across three modes (free conversation, role-play scenarios, and diary practice), plus vocabulary review, progress tracking, and related features. Available languages, levels, and features may change over time.

2. You must be eligible to use the Service

You must be at least [FOUNDER: confirm age, likely 16 or per local law] years old. You’re responsible for the accuracy of the information you give us and for keeping your account credentials secure.

3. AI nature of the Service — please read this section

You are interacting with an artificial intelligence, not a human tutor. Every response, correction, and roleplay character (the pharmacist, the landlord, the interviewer, etc.) is generated by a large language model. Before the start of your first session, and in this document, we tell you this clearly, as required by EU law (AI Act, Article 50).

Because of how AI language models work:

  • The tutor can be wrong. It may occasionally give an incorrect correction, an inaccurate translation, or a confusing or inconsistent response. Language corrections are a teaching aid, not a certified linguistic authority.
  • Roleplay is fiction. When the tutor plays a pharmacist, landlord, government clerk, or any other character, it is a practice exercise only. Nothing said in character is real medical, legal, immigration, financial, or housing advice, and must never be relied on as such. Always consult a qualified professional or the relevant official body for real decisions in these areas.
  • No guaranteed outcome. Mamagayo is a best-efforts learning tool (an “obligation de moyens,” not an “obligation de résultat,” for our French users): we do not promise you will reach a specific CEFR level, pass a specific exam (TEF/TCF or otherwise), or achieve any particular result. Mock exams and score estimates are practice aids, not official certification and not a guarantee of your real exam outcome.
  • Content safety. Our AI providers run automated filters to reduce harmful output, but no filter is perfect. If the tutor ever produces something offensive, unsafe, or clearly wrong, please use the in-app feedback (thumbs down) so we can review it.

4. Your account and acceptable use

You agree not to: use the Service to generate illegal, abusive, or harmful content; attempt to extract, reverse-engineer, or abuse the underlying AI models; share your account with others; or use the Service in a way that violates applicable law. We may suspend or terminate accounts that violate these Terms.

5. Subscriptions, quotas, and payment

6. Your content

You retain ownership of what you say and write to the tutor. You grant us a license to process it as needed to provide the Service (generate responses, remember your progress, produce diary entries and vocabulary lists) as described in our Privacy Policy. You’re responsible for not submitting content that infringes someone else’s rights or that you don’t have the right to share.

7. Disclaimers and limitation of liability

To the fullest extent permitted by applicable law:

  • The Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except where such warranties cannot be excluded under mandatory consumer-protection law (in France, including the legal warranty of conformity and the hidden-defects warranty, which are not affected by this clause).
  • We are not liable for indirect, incidental, or consequential damages arising from your use of the Service, including reliance on AI-generated content as described in §3.
  • Our total liability for any claim arising from these Terms or the Service is limited to the amount you paid us in the [FOUNDER: 12 months] preceding the claim, except where such a cap cannot be applied under applicable law.
  • Nothing in this section limits our liability for gross negligence, willful misconduct, or death or personal injury caused by us, or any other liability that cannot lawfully be excluded or limited.

8. Governing law and disputes

These Terms are governed by French law. 9. Changes to the Service or these Terms

We may update these Terms from time to time. We’ll notify you of material changes in-app or by email before they take effect. Continued use after changes take effect means you accept the updated Terms.

10. Termination

You can stop using the Service and delete your account at any time (see Privacy Policy §6). We may suspend or terminate your access for violating these Terms, non-payment, or if required by law.
